Welcome to Salty Marsh Studio! These Terms of Service ("Terms") cover your use of saltymarshstudio.com (the "Site") and any purchase you make from us. Salty Marsh Studio is a small, independent art studio on North Carolina's Crystal Coast, owned by Pattie Overcash ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms.

1. Our artwork and your print

Every art print is personally signed by Pattie Overcash.
Prints come with a cardboard backing board in a protective clear sleeve. Frames are not included. Any frames, walls, or props shown in photos are for display only.
Colors may vary. Each screen shows colors a little differently, and printing can differ slightly from what you see on a monitor or phone. These small differences are not considered defects.
We do our best to describe sizes and details accurately. If you have a question before you buy, please contact us.

2. Copyright and permitted use

All artwork, images, text, and other content on the Site are the original work of Pattie Overcash / Salty Marsh Studio. They are protected by copyright and other intellectual property laws.
Buying a print gives you the physical print only. Copyright and all reproduction rights stay with Pattie Overcash.
Prints are sold for personal display. Without our prior written permission, you may not copy, scan, photograph for reproduction, reprint, digitize, modify, or distribute the artwork. You also may not use it on products for sale, or for any other commercial purpose. This includes using it to train or prompt AI tools.
You're welcome to share photos of your print hanging in your home on social media. We'd love it if you tagged us!

3. Orders, pricing, and payment

All prices are in U.S. dollars. They may change at any time without notice, but your order is charged at the price shown when you placed it.
Payments are processed securely through our e-commerce platform and its payment providers.
We may refuse or cancel any order, for example because of a pricing or listing error, suspected fraud, or limited stock. If we cancel an order you have already paid for, we will refund you in full.
You agree to give us accurate, complete billing and shipping information.

4. Shipping, returns, and refunds

Shipping is covered by our Shipping Policy, and returns and refunds by our Refund Policy. Both are part of these Terms. In short, we ship within the United States only, and all sales are final except for items that arrive damaged or defective, or the wrong item.

5. Wholesale

Wholesale orders placed through our wholesale channel may be subject to that channel's separate terms.

6. Using the Site

You agree not to use the Site for anything unlawful. You also agree not to interfere with how the Site works, or to try to get unauthorized access to it or to other users' information. We may update, change, or discontinue any part of the Site at any time.

7. Third-party links and services

The Site may link to, or rely on, services run by others (such as payment processors and shipping carriers). We are not responsible for their content or practices.

8. Privacy

Our Privacy Policy explains how we collect and use your personal information.

9. Disclaimers and limitation of liability

To the fullest extent the law allows:
- the Site and our products are provided "as is" and "as available", without warranties beyond those stated in our policies or required by law;
- Salty Marsh Studio is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products;
- our total liability for any claim related to a purchase is limited to the amount you paid for that order.

Nothing in these Terms limits any rights you have that cannot legally be waived.

10. Indemnification

You agree to hold Salty Marsh Studio and Pattie Overcash harmless from claims that arise from your misuse of the Site or our artwork, or from your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in North Carolina.

12. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page, and changes apply to orders placed after they are posted.
